Barb, Jarrod, and I will be out of town Thursday for a special Washington Senate luncheon and briefing with Senator Specter, Frist, my gal Liddy, Bush advisor Oliver, Santorum, Coleman, Collins, followed by a meet and greet photo reception/buffet with Arnold Schwarzenegger (our next CA gov).

I called Mark Platts last week and asked him for a one-page high level overview for Lauxmont Farm/Park concept since we will be meeting again with Senator Specter on this issue. I hope to have that in my hands or e-mailed to me by tomorrow.

I’ve been busy…Do you know if anyone has made contact with that Mike Nixon guy who is the Indian specialist? I think we need his added federal experience to visit with your team concerning the project. You may want to check with O’Shell (although he’s in Boston this week) Platts or Dave Keiter about him. We need him onboard ASAP.

I have a contact sheet that has names and e-mail information of some key people that should be working together as partners with the Lauxmont initiative. I’ll send it later under separate cover as soon as get time.

You may want to check with Jackie about how we or she can set up a non-profit, tax deductible fund for contributors on behalf of the Township’s Indian and land preservation efforts.

PS I’ve heard talk that Engineer John Klinedinst sent out a salty e-mail about me/Board in which you were copied concerning my desire to get the Lauxmont issue public and moving forward.

As I told you on the phone, Solicitor Keiter had called me the day after the motion to make me aware of JK’s criticisms of the Board’s vote, an initiative that had a positive review by the solicitor.

Earlier this afternoon I spoke with don Welsh, the EPA Region III administrator (see wb for details – http://www.epa.gov/region3/ra.htm - I used to work with him at DEP) about the Lauxmont project to ask him about any potential EPA role with regard to what the Kohrs are proposing to do and if he had any good contacts with the administration we should be speaking with about our effort particularly in the Dept. of Interior.

With regard to the development of the property EPA might have a role if wetlands are encountered (primary role would go to the Corps of Engineers) and or protected habitat (i.e. the famous bogg turtle). Don told me that if a “404 federal permit” under the National Environmental Policy Act (NEPA) were required that would mean a “major environmental action” is being proposed by the developer. This would then entail the undertaking of an Environmental Impact Statement study to be done at the developer/owners expense which EPA could potentially provide comment.

Of course, all of this involves a great deal of time and cost something that may give us continued leverage over the Kohrs. Don did note that this situation sounded similar to other situations in the region (he mentioned one in WV) that the owner/”developer” proposed all of these subdivisions (the one in West VA. Involved a Civil War battlefield site) in order to get the asking price up from the public sector. I told him that we already considered that to be a possibility in this case and we are proceeding cautiously.

With regard to a contact within Dept. of Interior he told me that he couldn’t think of anybody off the top of his head but that he would get back to me with a POC who would be similar political appointee like himself of the Bush administration in the Philadelphia region. So I’ll wait to hear from him.

Again, I believe all of this discussion underscored the need to bring Mike Nixon who has the knowledge with regard to protecting sites (federal regulations etc) and in acquiring those sited. FYI
